Cutting Down a Tree in the Outer Banks? Read This First

In the Outer Banks region of North Carolina, whether you need a permit to remove a tree depends on which town your property is in, each municipality often has its own rules.

What Outer Banks Towns Regulate About Tree Removal Permits and Why

Every town has its own approach. Kill Devil Hills is known for being strict. Duck can vary depending on your location. But a few patterns are common:

  • Large trees or native species often have protections
  • Trees near water or dunes usually have extra rules
  • Ignoring the rules can lead to fines or delays

Nags Head (and similar areas)

  • Trees over 6 inches in diameter (DBH) generally cannot be removed without a permit, even on private property.

  • In designated environmental or planned districts, the rules are even stricter. Removal is only allowed under specific circumstances such as construction zones or if the tree is diseased or hazardous—and often only with prior approval or arborist confirmation.

Duck

  • On developed lots, homeowners may remove trees under 24 inches DBH without a permit, as long as the lot retains at least 15% vegetative coverage. If removal brings vegetation below that threshold, a vegetation management plan is needed.

  • For undeveloped or vacant land, any tree over 6 inches DBH cannot be removed without both a building/land disturbance permit and a vegetation management plan.

  • Regardless of development status, trees 24 inches or larger require a specific tree removal permit plus that vegetation plan.

Other Towns: Manteo, Duck, Kill Devil Hills, Southern Shores, Kitty Hawk

  • These municipalities also enforce strict penalties or fines for unauthorized tree removal. For example:

    • Kill Devil Hills prohibits removal of trees larger than 12 inches in their Maritime Forest Environmental District, unless it’s for required structures like buildings or driveways.

    • Manteo protects historic live oaks (100+ years old with 24-inch caliper), and if such a tree must be removed, you’re often required to plant multiple similar trees.

    • Duck and others impose fines ranging from $200–$400 per tree, and civil penalties up to $5,000 if canopy removal can’t be quantified.


What You Should Do

  1. Identify the town where your property is located.
  2. Look up that town’s tree- or vegetation-related ordinances, often under planning or development code sections.
  3. If your tree is over 6 inches DBH, especially in undeveloped areas or environmental zones, assume a permit may be required.
  4. Contact the local Planning or Community Development department—they can confirm whether a permit or plan is needed and guide you through the process.

It is understandable. One big tree can block an otherwise perfect view. But a blocked view alone is not usually enough reason for removal. Healthy, native trees often need a permit. Even trimming can require approval.

  • Is it near dunes, marshes, or water runoff?
